Terms of service

1. General

These Terms and Conditions govern the sale of goods by Mercer Leathers (“Seller”) to the customer (“Buyer”) and apply to the exclusion of any other terms or conditions provided by the Buyer, whether verbally, in writing, or as part of any standard purchasing documentation, unless expressly agreed to in writing by Mercer Leathers. These terms may be amended only with Mercer Leathers’ written confirmation, and specific conditions at the time of purchase may override these general terms.

2. Prices

All prices are net, FOB Palm Beach, FL. Prices exclude shipping, packaging, taxes, and fees unless otherwise specified. Prices are subject to change without prior notice and should be confirmed at time of ordering.

3. Terms

Full payment, including shipping and applicable charges, is required prior to shipment unless alternative terms have been pre-approved in writing. First-time customers are subject to pro forma invoicing or COD. Payment methods include certified check, ACH, and major credit cards. Net terms may be extended upon credit approval. Late payments are subject to monthly interest charges.

4. Warranty

Goods are sold as-is without warranty, except that they will conform to Mercer Leathers’ published Product Technical Specifications at the time of dispatch. Normal wear, misuse, or alterations by the customer are not covered.

5. Ordering

All orders must include an official Purchase Order or Order Number for traceability. Submission of a Purchase Order constitutes acceptance of Mercer Leathers’ Terms and Conditions.

6. Overage and Underage

Due to the natural variance in hide size, orders are fulfilled within ±10% of the requested square footage unless otherwise agreed upon. Leathers are sold by the square foot in full hide increments.

7. Dye Lot Variations

Leather is a natural material; variations in color, grain, and texture are inherent and acceptable. Images on our website may not perfectly reflect actual product appearance. Cuttings for Approval (CFA) are highly recommended. Orders placed without requesting a CFA will be assumed to accept natural variations.

8. Special Order and Custom Order Items

Special and custom order items are final sale and non-cancelable. A non-refundable 50% deposit is required upon placing the order. An overage may apply to final quantities.

9. Reserves

Reserves are valid for 14 calendar days and may be extended upon written approval from Mercer Leathers.
